Yup, all the game content, characters, some specific mechanics would still be protected. So nobody could make a true Shenmue 3, but it's now perfectly legal for someone to release a Flappy Bird clone called "Shenmue 3" in the US.

I did a quick search and if its the same over all Intellectual Properties then its 20 years after it was first filed.

The Shenmue postmortem presentation with Yu Suzuki and Mark Cerny is coming up at the end of this month at GDC anyway. Most likely just an interesting look at the series but we can still hold out some hope that at the end, Yu Suzuki finishes by saying "And Shenmue 3....will be released on PS4 in late 2014" then just drops the mic and walks out.
